
FemTech Landscape and User Privacy Risk/Implications Post-Roe
The overturning of Roe v. Wade in 2022 has significantly heightened concerns regarding the privacy and security of reproductive health data in the United States. With the increased potential for the criminalization of people seeking abortions, there is a substantial risk that reproductive health data collected from FemTech applications could be weaponized against users attempting to access abortion services or even suffering a miscarriage. This risk is exacerbated by inadequate regulatory oversight and lack of user-friendly data privacy policies. This memo aims to outline current data collection practices employed by FemTech platforms, discuss the implications of inadequate privacy measures in a post-Roe world, and propose policy recommendations to protect the privacy and security of FemTech users.
